Lots of gunship footage shows that the operators don't really take prisoners. Under the Geneva Convention, are the operators actually permitted to shoot unarmed targets once they surrender?

Soldiers will go to prison if they shoot to kill unarmed enemy personnel once they drop their guns and start running, so why does this not apply to gunship operators?
