Legal question - likelihood of adultery charge?
Posted on
Throwaway account.
I'm on active duty stationed in NC. My legal spouse and I are in the one-year separation phase of a divorce. I've been seeing someone recently (a civilian) and she's now pregnant, we're going to have the baby just before the divorce is finalized. My spouse and I are amicable and on good terms, she's aware of the pregnancy.
I recognize I could technically be charged with adultery under article 134 in a court-martial after I notify my COC due to my divorce not yet being final. My question is, how likely is this really? I've heard and read a bunch of different stories about adultery and the UCMJ, especially when it comes to being prejudicial to good order and discipline & bringing discredit on the service. Do I really have anything to worry about if it's copacetic with my spouse and we're on track for divorce anyway?
Thanks for any input.
