Hey everyone - first time poster long time lurker.
I am a prior service guy, was in once upon a time - got out, got back in. During my break in service - no criminal trouble, not even a ticket.
I am currently in the final stages of the MEB process as well, so staying out of sight and out of mind is my number one priority.
Well today I was notified by my CO that I have an active (non extraditable) arrest warrant dating back to before I re-enlisted THATS out of a state North of Georgia but south of North Carolina. I was residing Somewhere there - while giving me some information, my CO was relatively vague, but told me he has no plans for UCMJ or anything, just told me to get it handled fast. I contacted the LEA that has the warrant and all they told me was that I had an active warrant for “breach of trust - Less than $2,000” and that since I am nowhere near the state, to get a lawyer.
I had no idea this warrant existed, and even when I was background checked and FINGERPRINTED by this same agency prior to my reenlistment (to reenlist as prior service), the warrant never came up - but it’s dated prior to all that. Weird, yea?
The backstory of what I believe this is from is that I was living in a house with several roommates, and nobody was on a lease. We just all paid one guy rent and he paid the landlords. He moved out, so I became the guy to pay rent. Well people came and went, I had the utilities and such in my name and was writing checks or paying cash every month to the landlord. Mind you I N E V E R signed a lease, ever. Not even a lease application. The landlords are well above the age of 70. So I was preparing to relocate to a different state, and notified the landlords 60 days prior to my expected leaving date. They told me to find new roommates and set up a meeting. So we all met, things went great. At that time, each of the 3 new roommates handed the landlord their deposit of $250, which insured they would be allowed to stay. Well, I moved out - and as a parting gift I left my $1200 washer and dryer, and my lawn mower. I changed all utilities out of my name before I left and into one of the new roommates with their permission.
From what I’ve gathered... the roommates stopped paying rent and/or moved out - and since I was the one prior to them paying rent with checks or cash and the utilities in my name at one point, they’re trying to hold me responsible for the non-payment of rent which somehow equates to Breach of Trust? This whole thing is whack.
I need some advice. What do I do? Obviously I can’t go turn myself in and sit in jail at this said state. Civilian lawyer is step number one. JAG advised me of the same.
But can I face any UCMJ action because of this? Can my MEB be terminated and I be AdSep’d for false enlistment? What should I be afraid of in this situation other than fighting a ridiculous charge?
